The Oklahoma Government Transparency & Performance Act (OK-GT&P)
Oklahoma state companion to GT&P. Extends the Oklahoma Open Records Act (Okla. Stat. Title 51 Sec. 24A), Open Meeting Act (Okla. Stat. Title 25), State Auditor and Inspector oversight, and the Oklahoma Medicaid False Claims Act.
THE OKLAHOMA GOVERNMENT TRANSPARENCY & PERFORMANCE ACT (OK-GT&P)
Vehicle: State passage. Oklahoma Legislature, regular session. Primary referral to House Government Oversight / Appropriations and Budget and Senate General Government / Appropriations.
SECTION 1. SHORT TITLE
This Act may be cited as the “Oklahoma Government Transparency & Performance Act (OK-GT&P).”
SECTION 2. LEGISLATIVE FINDINGS AND INTENT
The Legislature finds that Oklahoma operates transparency infrastructure under the Open Records Act (Okla. Stat. Title 51 Sec. 24A.1 et seq.) and Open Meeting Act (Okla. Stat. Title 25 Sec. 301 et seq.); that the State Auditor and Inspector audits under Okla. Stat. Title 74 Sec. 212 et seq.; that state-agency performance reporting occurs through the Office of Management and Enterprise Services under Okla. Stat. Title 62 Ch. 1 and the LOFT (Legislative Office of Fiscal Transparency) under Title 74 Sec. 453; that whistleblower protection for state employees operates under Okla. Stat. Title 74 Sec. 840-2.5 (Whistleblower Act); that the Oklahoma Personnel Act under Okla. Stat. Title 74 Ch. 27A governs state employment; and that the Oklahoma Medicaid False Claims Act under Okla. Stat. Title 63 Sec. 5053 et seq. provides a qui-tam-style recovery mechanism. This Act extends these frameworks.
TITLE I — DEFINITIONS & COORDINATION WITH OKLAHOMA LAW
Sec. 101. Definitions
- (a) “State agency” has the meaning in Okla. Stat. Title 62 Sec. 34.11.
- (b) “SAI” means the State Auditor and Inspector under Okla. Stat. Title 74 Sec. 212.
- (c) “OMFCA” means the Oklahoma Medicaid False Claims Act under Okla. Stat. Title 63 Sec. 5053.
Sec. 102. Coordination with Existing Oklahoma Law
- (a) Consistent with:
- Okla. Stat. Title 51 Sec. 24A.1 et seq. (Open Records Act).
- Okla. Stat. Title 25 Sec. 301 et seq. (Open Meeting Act).
- Okla. Stat. Title 74 Sec. 212 et seq. (SAI).
- Okla. Stat. Title 62 Ch. 1 (OMES; performance reporting).
- Okla. Stat. Title 74 Sec. 453 (LOFT).
- Okla. Stat. Title 74 Sec. 840-2.5 (Whistleblower Act).
- Okla. Stat. Title 74 Ch. 27A (Oklahoma Personnel Act).
- Okla. Stat. Title 63 Sec. 5053 (OMFCA).
- Okla. Stat. Title 75 (Administrative Procedures Act).
TITLE II — STATE-AGENCY OUTCOME PUBLICATION
Sec. 201. Oklahoma Agency Outcome Dashboard
- (a) OMES, in coordination with SAI and LOFT, shall maintain an Oklahoma Agency Outcome Dashboard (“OK-AOD”).
- (b) Each State agency shall publish, for each major program in its annual budget submission, machine-readable performance data on cost per unit, output volume, and outcome measurement.
- (c) OK-AOD published in machine-readable form, updated at least quarterly.
Sec. 202. Integration with Budget Submissions
- (a) Beginning with the fiscal year following enactment, each State agency shall include OK-AOD data in its budget submission to OMES and LOFT.
TITLE III — STATE CIVIL-SERVICE ACCOUNTABILITY
Sec. 301. Published Performance Expectations
- (a) Okla. Stat. Title 74 Ch. 27A shall be applied so that each executive-level and director-level State-agency position’s appointing authority establish and publish annual performance expectations tied to agency program performance measures.
- (b) Failure to satisfy published expectations for two consecutive review cycles shall constitute grounds for non-retention.
TITLE IV — REGULATORY PARTICIPATION
Sec. 401. Oklahoma Regulatory Participation Dashboard
- (a) The Office of Administrative Rules in the Secretary of State’s office, in coordination with agencies that adopt rules under Okla. Stat. Title 75 (Administrative Procedures Act), shall publish an Oklahoma Regulatory Participation Dashboard displaying docket status, comment text, and summary disposition for each pending rulemaking.
- (b) Dashboard is informational.
TITLE V — WHISTLEBLOWER REWARDS
Sec. 501. Oklahoma Medicaid False Claims Act Reward Enhancement
- (a) Okla. Stat. Title 63 Sec. 5053.4 (recovery awards) is hereby amended so that a qui tam relator under OMFCA may receive a share aligned with the federal range under 31 U.S.C. Sec. 3730(d).
- (b) Amounts payable drawn from amounts recovered to the State.
- (c) This Section does not create a general state false-claims cause of action outside the Medicaid-fraud context of OMFCA.
TITLE VI — IMPLEMENTATION & GENERAL PROVISIONS
Sec. 601. Severability
If any provision is held invalid, the invalidity shall not affect the remainder.
Sec. 602. Effective Date
This Act shall take effect November 1 of the year following enactment.
