New Jersey state companion to MEWRA. Uses the Charter School Program Act (N.J.S.A. 18A:36A-1 et seq.), dual-enrollment pathways, and the State Employment and Training Commission. New Jersey does not operate an ESA or tax-credit scholarship.
THE NEW JERSEY MERIT-BASED EDUCATION & WORKFORCE REFORM ACT (NJ-MEWRA)
Vehicle: State passage. New Jersey Legislature, regular session. Primary referral to Assembly / Senate Education.
SECTION 1. SHORT TITLE
This Act may be cited as the “New Jersey Merit-Based Education & Workforce Reform Act (NJ-MEWRA).”
SECTION 2. LEGISLATIVE FINDINGS AND INTENT
The Legislature finds that the Charter School Program Act is codified at N.J.S.A. 18A:36A-1 et seq.; that dual-enrollment and early-college pathways operate under N.J.S.A. 18A:61C; that the Department of Education publishes the NJ School Performance Report; that the State Employment and Training Commission operates under N.J.S.A. 34:15C; and that New Jersey does not operate an ESA or tax-credit scholarship. This Act extends these frameworks consistent with the public-school framework.
TITLE I — DEFINITIONS & COORDINATION WITH NEW JERSEY LAW
Sec. 101. Definitions
- (a) “New Jersey outcome-based school” means a public charter school authorized under Title II by the New Jersey Outcome-Based School Authorizer (“NJ-OBSA”) under N.J.S.A. 18A:36A-1 et seq.
- (b) “SETC” means the State Employment and Training Commission.
- (c) “Dual-enrollment pathway” has the meaning given in N.J.S.A. 18A:61C.
Sec. 102. Coordination with Existing New Jersey Law
- (a) Consistent with:
- N.J.S.A. 18A:36A-1 et seq. (Charter Schools).
- N.J.S.A. 18A:61C (dual enrollment).
- N.J.S.A. 34:15C (SETC).
TITLE II — NEW JERSEY OUTCOME-BASED SCHOOL AUTHORIZER
Sec. 201. Establishment of NJ-OBSA
- (a) The Commissioner of Education, in coordination with the State Board of Education, shall designate a New Jersey Outcome-Based School Authorizer (“NJ-OBSA”) under N.J.S.A. 18A:36A-1 et seq.
- (b) NJ-OBSA shall authorize provisional public charter schools without requiring regional-accreditor accreditation.
Sec. 202. Outcome-Based Authorization Standard
- (a) Authorization requires publication of outcome metrics under Sec. 401.
- (b) Facilities, safety, and background-check standards applicable under N.J.S.A. 18A.
- (c) Four-year term, renewable on thresholds.
TITLE III — EDUCATION-FUND PORTABILITY (Charter & Dual-Enrollment Rewire)
Sec. 301. Charter and Dual-Enrollment Funding
- (a) A Title II-authorized school operating as a public charter under N.J.S.A. 18A:36A-1 et seq. is entitled to per-pupil State Aid on the same terms as other public charters.
- (b) NJ-OBSA schools may participate in dual-enrollment pathways under N.J.S.A. 18A:61C.
Sec. 302. Workforce Disbursements
- (a) SETC shall ensure that within 24 months, at least 50 percent of WIOA-aligned workforce-program disbursements flow to providers publishing outcome data in the NJ-OBSA Registry or Federal NLMF.
TITLE IV — PUBLISHED OUTCOME METRICS
Sec. 401. New Jersey Outcome-Metrics Registry
- (a) NJ-OBSA shall publish completion rate; one- and three-year earnings medians; licensure/NJRMC/FRAC attainment.
- (b) Data sources: NJ DOL wage records and DOE longitudinal data.
Sec. 402. Coordination with the Federal NLMF
- (a) Crosswalked to the Federal NLMF.
- (b) Nothing authorizes disclosure of PII except as permitted under OPRA (N.J.S.A. 47:1A-1 et seq.) and FERPA.
TITLE V — ENFORCEMENT & REMEDIES
Sec. 501. Non-Compliant Provider Remedies
- (a) Suspension of NJ-OBSA authorization; Registry suspension; administrative penalty up to $500,000 per willful violation.
- (b) No private right of action.
TITLE VI — IMPLEMENTATION & GENERAL PROVISIONS
Sec. 601. Severability
If any provision is held invalid, the invalidity shall not affect the remainder.
Sec. 602. Effective Date
This Act shall take effect on the July 1 following enactment.
