The Missouri Government Transparency & Performance Act (MO-GT&P)
Missouri state companion to GT&P. Extends Missouri Personnel Law (Mo. Rev. Stat. Ch. 36), Missouri Sunshine Law (Ch. 610), and Missouri Medicaid Fraud Prevention (Mo. Rev. Stat. Sec. 191.905 et seq.).
THE MISSOURI GOVERNMENT TRANSPARENCY & PERFORMANCE ACT (MO-GT&P)
Vehicle: State passage. Missouri General Assembly, regular session. Primary referral to House / Senate Government Efficiency / Appropriations.
SECTION 1. SHORT TITLE
This Act may be cited as the “Missouri Government Transparency & Performance Act (MO-GT&P).”
SECTION 2. LEGISLATIVE FINDINGS AND INTENT
The General Assembly finds that Missouri’s State Personnel Law operates under Mo. Rev. Stat. Ch. 36; that the Missouri Sunshine Law operates under Mo. Rev. Stat. Ch. 610; that the Missouri Office of Administration’s Division of Budget and Planning administers the Executive Budget under Mo. Rev. Stat. Ch. 33; that the Committee on Legislative Research provides fiscal analysis under Mo. Rev. Stat. Ch. 23; that Missouri does not have a general False Claims Act but recovers Medicaid fraud under the Missouri Medicaid Fraud Prevention Act, Mo. Rev. Stat. Sec. 191.905 et seq.; and that the Medicaid Fraud Control Unit operates under the Office of the Attorney General pursuant to 42 U.S.C. Sec. 1396b(q). This Act extends these frameworks.
TITLE I — DEFINITIONS & COORDINATION WITH MISSOURI LAW
Sec. 101. Definitions
- (a) “MO-DBP” means the Division of Budget and Planning in the Office of Administration.
- (b) “Publicly visible outcome” means a metric published under Sec. 201.
- (c) “MFCA” means Missouri’s Medicaid Fraud Prevention Act under Mo. Rev. Stat. Sec. 191.905 et seq.
Sec. 102. Coordination with Existing Missouri Law
- (a) Consistent with:
- Mo. Rev. Stat. Ch. 36 (State Personnel Law).
- Mo. Rev. Stat. Ch. 610 (Sunshine Law).
- Mo. Rev. Stat. Ch. 33 (Division of Budget and Planning).
- Mo. Rev. Stat. Sec. 191.905 et seq. (Medicaid Fraud Prevention Act).
TITLE II — OUTCOME-BASED BUDGETING
Sec. 201. Outcome Metrics for Covered Programs
- (a) Each covered program in the Executive Budget shall publish at least three outcome metrics.
- (b) The Division of Budget and Planning shall publish the Missouri Outcome Dashboard in machine-readable form.
Sec. 202. Fiscal-Note Outcome Integration
- (a) Committee on Legislative Research fiscal notes shall identify outcome metrics from Sec. 201.
TITLE III — CIVIL-SERVICE MERIT PROTECTIONS
Sec. 301. Codification of Performance-Standards Protections
- (a) Mo. Rev. Stat. Ch. 36 is amended so that nothing precludes policy-influencing-position classifications with publicly posted performance standards.
- (b) Classifications consistent with Mo. Rev. Stat. Sec. 36.030 (unclassified service).
TITLE IV — MISSOURI MEDICAID FRAUD QUI TAM (MFCA Rewire)
Sec. 401. Medicaid Fraud Qui Tam Authority
- (a) Given that Missouri does not have a general False Claims Act, this Title operates as a Medicaid-specific qui tam authority under Mo. Rev. Stat. Sec. 191.905 et seq. and in coordination with the Medicaid Fraud Control Unit under 42 U.S.C. Sec. 1396b(q).
Sec. 402. Credentialing and Outcome-Data Fraud
- (a) A person presenting a materially false or fraudulent claim involving MORMC, Federal FRAC, MO-OBSA outcome data, or Medicaid-related credential claims is liable to the State for a civil penalty and treble damages.
Sec. 403. Whistleblower Award
- (a) A whistleblower whose information leads to recovery shall receive between 15 and 30 percent of the State recovery, as determined by the Attorney General.
TITLE V — IMPLEMENTATION & GENERAL PROVISIONS
Sec. 501. Severability
If any provision is held invalid, the invalidity shall not affect the remainder.
Sec. 502. Effective Date
This Act shall take effect August 28 of the year following enactment.
