Minnesota state companion to AI Workforce. Labor-protective training credits and DEED matching grants. Builds on M.S. Ch. 302A and Ch. 322C (business entities), M.S. Ch. 290 credits, DEED, and Department of Commerce regulatory frameworks.
THE MINNESOTA PRO-WORKER AI WORKFORCE ACT (MN-AI-WORKFORCE)
Vehicle: State passage. Minnesota Legislature, regular session. Primary referral to House / Senate Economic Development / Taxes.
SECTION 1. SHORT TITLE
This Act may be cited as the “Minnesota Pro-Worker AI Workforce Act (MN-AI-Workforce).”
SECTION 2. LEGISLATIVE FINDINGS AND INTENT
The Legislature finds that Minnesota business entities are governed by M.S. Ch. 302A (Business Corporation Act) and Ch. 322C (LLCs); that M.S. Ch. 290 provides income-tax credits; that the Department of Employment and Economic Development (DEED) operates under M.S. Ch. 116J; that M.S. Ch. 45 authorizes financial-services regulation; and that M.S. Ch. 181 and Ch. 363A protections apply. This Act extends these frameworks.
TITLE I — DEFINITIONS & COORDINATION WITH MINNESOTA LAW
Sec. 101. Definitions
- (a) “Qualified MN AI Workforce Training” means training toward an MNRMC or Federal FRAC in AI fields.
- (b) “Minnesota Innovation Sandbox” means a regulatory sandbox under Title III.
- (c) “Qualified small business” has the meaning given in M.S. Ch. 302A or Ch. 322C.
Sec. 102. Coordination with Existing Minnesota Law
- (a) Consistent with:
- M.S. Ch. 302A; Ch. 322C.
- M.S. Ch. 290.
- M.S. Ch. 116J (DEED).
- M.S. Ch. 45.
TITLE II — MINNESOTA AI WORKFORCE TRAINING CREDIT (Worker-Protective Rewire)
Sec. 201. Training Credit and DEED Matching Grant
- (a) A new credit is added to M.S. Ch. 290 for qualified AI workforce training expenditures, modeled on the Greater Minnesota Job Expansion framework.
- (b) Credit availability is conditioned on compliance with M.S. Ch. 181 and Ch. 363A; priority to employers with a labor-management partnership.
- (c) A parallel matching grant program is authorized at DEED under M.S. Ch. 116J.
- (d) Coordinated with federal IRC Sec. 45BB; aggregate cap.
- (e) Department of Revenue and DEED jointly administer.
TITLE III — MINNESOTA INNOVATION SANDBOX
Sec. 301. Establishment of the Minnesota Innovation Sandbox
- (a) A Minnesota Innovation Sandbox is established within DEED, covering occupational-licensure activities under M.S. Ch. 214 and financial-product innovation under M.S. Ch. 45.
- (b) Twenty-four-month terms; renewable.
Sec. 302. Scope
- (a) Covers state-licensed activities and financial activities to the extent not preempted.
TITLE IV — SMALL-BUSINESS FORMATION
Sec. 401. Expedited Formation Pathway
- (a) The Secretary of State shall implement an expedited formation pathway for M.S. Ch. 302A and Ch. 322C entities within 24 hours.
Sec. 402. Single-Portal Licensing
- (a) The Minnesota eLicensing portal shall operate a single-portal licensing system for state-level occupational licenses under M.S. Ch. 214.
TITLE V — IMPLEMENTATION & GENERAL PROVISIONS
Sec. 501. Severability
If any provision is held invalid, the invalidity shall not affect the remainder.
Sec. 502. Effective Date
This Act shall take effect on January 1 of the year following enactment.
