Idaho state companion to MEWRA. Builds on the Idaho Parental Choice Tax Credit (HB 93, 2025), Empowering Parents grant program (Idaho Code Sec. 33-1019), Idaho charter framework (Idaho Code Title 33 Ch. 52), and Idaho LAUNCH.

THE IDAHO MERIT-BASED EDUCATION & WORKFORCE REFORM ACT (ID-MEWRA)

Vehicle: State passage. Idaho Legislature, regular session. Primary referral to House / Senate Education.

SECTION 1. SHORT TITLE

This Act may be cited as the “Idaho Merit-Based Education & Workforce Reform Act (ID-MEWRA).”

SECTION 2. LEGISLATIVE FINDINGS AND INTENT

The Legislature finds that Idaho enacted the Parental Choice Tax Credit under HB 93 (2025), a refundable income-tax credit for qualifying educational expenses; that Idaho operates the Empowering Parents grant program under Idaho Code Sec. 33-1019; that Idaho’s charter-school framework operates under Idaho Code Title 33 Ch. 52, with the Idaho Public Charter School Commission established under Idaho Code Sec. 33-5213; that Idaho LAUNCH provides workforce training under Idaho Code Sec. 33-2424 et seq. (HB 24, 2024); that Idaho publishes school-performance data through the State Department of Education; and that the Idaho State Board of Education operates under Idaho Code Title 33 Ch. 1. This Act extends these frameworks.

TITLE I — DEFINITIONS & COORDINATION WITH IDAHO LAW

Sec. 101. Definitions

  1. (a) “Idaho outcome-based school” means a provisional school authorized under Title II by the Idaho Outcome-Based School Authorizer (“ID-OBSA”).
  2. (b) “ID-PCTC” means the Parental Choice Tax Credit enacted via HB 93 (2025).
  3. (c) “ID LAUNCH” means Idaho LAUNCH under Idaho Code Sec. 33-2424 et seq.

Sec. 102. Coordination with Existing Idaho Law

  1. (a) Consistent with:
  • HB 93 (2025) Parental Choice Tax Credit.
  • Idaho Code Sec. 33-1019 (Empowering Parents grants).
  • Idaho Code Title 33 Ch. 52 (charter schools).
  • Idaho Code Sec. 33-2424 et seq. (Idaho LAUNCH).
  • Idaho Code Title 72 (Department of Labor).

TITLE II — IDAHO OUTCOME-BASED SCHOOL AUTHORIZER

Sec. 201. Establishment of ID-OBSA

  1. (a) The Idaho Public Charter School Commission, in coordination with the State Board of Education, shall designate an Idaho Outcome-Based School Authorizer (“ID-OBSA”) under Idaho Code Sec. 33-5213.
  2. (b) ID-OBSA shall authorize provisional schools without requiring regional-accreditor accreditation.

Sec. 202. Outcome-Based Authorization Standard

  1. (a) Authorization requires publication of outcome metrics under Sec. 401.
  2. (b) Facilities, safety, and background-check standards applicable under Idaho Code Title 33.
  3. (c) Four-year term, renewable on thresholds.

TITLE III — EDUCATION-FUND PORTABILITY

Sec. 301. Parental Choice Tax Credit Extension

  1. (a) A Title II-authorized school is eligible as a qualifying provider for ID-PCTC purposes.
  2. (b) The Idaho State Tax Commission and State Board of Education shall treat Title II-authorized schools equivalently.

Sec. 302. ID LAUNCH Grants

  1. (a) Idaho LAUNCH shall ensure that within 24 months, at least 50 percent of grant disbursements flow to providers publishing outcome data in the ID-OBSA Registry or Federal NLMF.

TITLE IV — PUBLISHED OUTCOME METRICS

Sec. 401. Idaho Outcome-Metrics Registry

  1. (a) ID-OBSA shall publish completion rate; one- and three-year earnings medians; licensure/IDRMC/FRAC attainment.
  2. (b) Data sources: the Idaho System for Educational Excellence and Department of Labor wage records, to the extent permitted by law.

Sec. 402. Coordination with the Federal NLMF

  1. (a) Crosswalked to the Federal NLMF.
  2. (b) Nothing authorizes disclosure of PII except as permitted under Idaho Code Title 74 (Public Records) and 20 U.S.C. Sec. 1232g (FERPA).

TITLE V — ENFORCEMENT & REMEDIES

Sec. 501. Non-Compliant Provider Remedies

  1. (a) Suspension of ID-PCTC participating status; ID-OBSA Registry suspension; administrative penalty up to $500,000 per willful violation.
  2. (b) No private right of action.

TITLE VI — IMPLEMENTATION & GENERAL PROVISIONS

Sec. 601. Severability

If any provision is held invalid, the invalidity shall not affect the remainder.

Sec. 602. Effective Date

This Act shall take effect July 1 of the year following enactment.
